Director's Penalty Notice Advisory
A Director Penalty Notice is a formal notice issued by the Australian Taxation Office that can make company directors personally liable for certain unpaid company debts, including PAYG, Superannuation, and GST. It is a strong enforcement mechanism that allows the ATO to pursue recovery from a director’s personal assets if appropriate action is not taken within 21 days.
A Director's Penalty Notice usually provides a director with 21 days to take one of the following options:
1) Appoint a Small Business Restructuring practitioner;
2) Appoint a Voluntary Administrator;
3) Liquidate the Company; or
4) Pay the debt in full
During this period we will review your financial situation to determine the most appropriate strategy to help you avoid becoming personally liable for certain company debts.
Small Business Restructure
A Small Business Restructure allows the director to retain control of their company whilst provides a valuable pathway for businesses experiencing financial stress.
The primary aim of a Small Business Restructure is to give directors and the company time to develop and present a proposal to creditors to repay outstanding liabilities, either in full or in part, over a period of up to three years. This creates a more manageable repayment arrangement and supports the business in its recovery. Overall, it establishes a clear framework for addressing financial challenges and working toward long-term stability.
Voluntary Administration
Similar to a Small business Restructure, a Voluntary Administration is used to keep the company trading while a licenced practitioner takes over for a small period of time to restructure its affairs. The experienced administrators will assess the company’s financial position, develop a recovery strategy, and oversee its execution.
Our objective is to stabilise the business, protect it from creditor action, and explore restructuring options or, where necessary, facilitate an orderly wind-down. Voluntary administration provides valuable breathing space to engage with creditors, preserve assets, and work toward a practical outcome. Throughout the process, our team provides expert guidance and support to help navigate a clear and strategic path forward.
